EPA Proposes Trucking Regulatory Reform

Responding to complaints from all segments of the industry, from manufacturers down to drivers, the U.S. Environmental Protection Agency (EPA) in July proposed changes and reforms to multiple heavy-duty engine regulations adopted in 2023, with the headline grabbing move a proposal to eliminate the super-frustrating “deratements” (software-driven engine slowdowns) caused by diesel exhaust fluid (DEF) system failures.

The move seeks to make changes in several areas to EPA air pollution regulations that went into effect in January 2023. The proposal leaves in place stringent new nitrogen oxide (NOx) emissions standards that are part of the 2023 regulations, but delays some of the rule’s implementation requirements, including longer useful-life guidelines and expanded emissions warranties.

For deratements, the proposal seeks to eliminate speed restrictions and replace the gradual power output reduction (to 5 MPH in many cases) with audible and visual dashboard alerts concerning DEF-related emissions issues. EPA officials note the proposed changes could save the industry up to $12 billion annually and take as much as $6,000 off the price of a new truck.
